Terms of Service

1. Definitions

In these Terms of Service ("Terms"), the following words and expressions shall have the meanings assigned to them:

  • "Param AI™" or "Service" means the online psychometric career assessment platform, including the website, web application, APIs, assessments, reports, career guidance tools, and all related services operated by the Company.
  • "Company", "we", "us", or "our" means Param Innovations Private Limited (CIN: U36000JH2025PTC025036), a company incorporated under the Companies Act, 2013, having its registered office at Tejpunj, Opp Sanskriti Appt Dhaiya, Indian School Of Mines, Dhanbad, Dhanbad-826004, Jharkhand, India.
  • "User", "you", or "your" means any individual or entity that accesses or uses the Service, including Student Users, Guardian Users, and Institutional Users.
  • "Student User" means any individual who takes an assessment through the Service.
  • "Guardian" means a parent, legal guardian, or any person authorized by law to act on behalf of a minor.
  • "Institutional User" means any school, college, educational institution, counseling organization, or corporate entity that accesses the Service for the purpose of administering assessments to students or employees.
  • "Assessment" means any psychometric test, questionnaire, career aptitude evaluation, or behavioral profiling instrument delivered through the Service.
  • "Report" means any output generated by the Service following an Assessment, including career recommendations, trait analyses, pathway simulations, fit scores, behavioral profiles, and any other analytical output.
  • "AI-Generated Content" means any content, analysis, recommendation, narrative, or insight produced by the Service's algorithmic and statistical models, including but not limited to career matching scores, trait projections, career pathway simulations, and behavioral assessments.
  • "Decision Support Tool" means a resource that provides information and analysis to assist in decision-making but does not itself constitute professional advice, certification, or a deterministic prediction of outcomes.
  • "Personal Data" has the meaning ascribed to it under the Digital Personal Data Protection Act, 2023.
  • "Data Principal" has the meaning ascribed to it under the Digital Personal Data Protection Act, 2023 and refers to the individual to whom Personal Data relates.
  • "Consent Manager" has the meaning ascribed to it under the Digital Personal Data Protection Act, 2023.
  • 2. Acceptance of Terms

    2.1. By creating an account, accessing, or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our Disclaimer, our Acceptable Use Policy, and our Refund Policy (collectively, the "Agreements").

    2.2. If you do not agree to any part of these Agreements, you must immediately cease use of the Service and delete your account.

    2.3. If you are accepting these Terms on behalf of an organization or institution, you represent and warrant that you have the authority to bind that organization to these Terms, and "you" and "your" shall refer to that organization.

    2.4. These Terms constitute a legally binding contract between you and the Company under the Indian Contract Act, 1872 and the Information Technology Act, 2000.

    3. Eligibility

    3.1. The Service is designed for users aged 13 years and above.

    3.2. Users aged 18 years and above may create accounts and use the Service independently.

    3.3. Users aged 13 to 17 years ("Minor Users") may use the Service only with verifiable consent from a Guardian or through an authorized Institutional User, in compliance with Section 9 of the Digital Personal Data Protection Act, 2023.

    3.4. Children under 13 years of age are not permitted to use the Service under any circumstances. If we discover that a child under 13 has provided Personal Data, we will delete such data promptly.

    3.5. You represent and warrant that all information you provide during registration is accurate, current, and complete. Providing false information constitutes a material breach of these Terms.

    3.6. Class Eligibility: The Service is designed exclusively for students enrolled in Classes 8 through 12 (or equivalent academic levels). Career assessments, psychometric instruments, and recommendations are calibrated for this academic range. Students outside Classes 8–12 may not receive meaningful or applicable career guidance. By using the Service, you confirm that you are currently enrolled in Class 8, 9, 10, 11, or 12.

    3.7. Accuracy of Student-Provided Information: The accuracy of career assessments, recommendations, and reports depends entirely on the information provided by the student, including but not limited to class, section, school name, and personal details. ParamAI™ does not independently verify this information. If a student provides incorrect, misleading, or false information (including selecting an incorrect class), ParamAI™ shall not be liable for any outcomes, recommendations, or decisions made based on the resulting assessment. It is the sole responsibility of the student (and their parent or guardian, if the student is a minor) to ensure all profile information is accurate and current.

    4. Nature of the Service — Critical Disclaimers

    THIS SECTION CONSTITUTES A MATERIAL PART OF THESE TERMS. PLEASE READ IT CAREFULLY.

    4.1. Param AI™ is a Decision Support Tool. The Service provides career guidance insights based on psychometric models, statistical algorithms, and behavioral analysis. It is designed to supplement — not replace — human judgment, professional counseling, and personal decision-making.

    4.2. The Service does NOT constitute:

  • professional career counseling, coaching, or mentoring;
  • legal, financial, medical, psychological, or educational advice;
  • a guarantee, promise, or prediction of any career outcome, academic admission, employment opportunity, or professional success;
  • a clinical psychological assessment, psychiatric evaluation, or mental health diagnosis;
  • a certification, accreditation, or qualification of any kind;
  • a binding recommendation that must be followed.
  • 4.3. Users MUST combine Service outputs with:

  • guidance from qualified career counselors, psychologists, or educators;
  • personal reflection and self-assessment;
  • family and mentor consultation;
  • independent research into career paths, educational institutions, and labor markets.
  • 4.4. No reliance. You acknowledge and agree that any reliance you place on the Service's outputs is strictly at your own risk. The Company expressly disclaims any responsibility for decisions made based on Reports or AI-Generated Content.

    4.5. Not a substitute for professional advice. Under no circumstances should the Service be treated as a substitute for professional advice from a qualified career counselor, psychologist, educational advisor, or any other professional. If you require professional advice, you should consult an appropriately qualified professional.

    4.6. Regulatory Status and Non-Affiliation. The Service is a self-administered, non-clinical career guidance and self-discovery tool. It is not certified, licensed, accredited, endorsed by, or affiliated with any psychological, psychiatric, educational, or professional regulatory body, including but not limited to:

  • the American Psychological Association (APA) or any APA division, and is not aligned, validated, or audited against the *Standards for Educational and Psychological Testing* (APA/AERA/NCME);
  • the Rehabilitation Council of India (RCI) or any RCI-registered professional category;
  • the British Psychological Society (BPS), European Federation of Psychologists' Associations (EFPA), or International Test Commission (ITC);
  • any state, national, or international psychology licensing board, examination authority, or test publisher.
  • 4.7. No Restricted Instruments. The Service does not administer, reproduce, score, or interpret any restricted, proprietary, or qualified-purchaser psychological instrument (including but not limited to MMPI, WAIS, WISC, 16PF, NEO-PI-R, MBTI, or any DSM-5/ICD-11-aligned diagnostic instrument). All scoring models, item banks, and trait constructs used by the Service are proprietary algorithms developed by the Company and are not validated, normed, or peer-reviewed against any published psychometric standard.

    4.8. No Practice of Psychology. Nothing produced by the Service constitutes the practice of psychology, counseling, psychotherapy, psychiatric evaluation, educational psychology, vocational rehabilitation, or any other regulated professional service. Users requiring such services must consult a professional licensed in their jurisdiction.

    5. AI and Algorithmic Disclaimers

    5.1. The Service uses a combination of rule-based algorithms, statistical models, psychometric scoring engines, and machine learning techniques to generate Reports and recommendations.

    5.2. Probabilistic nature. All outputs are probabilistic in nature and represent statistical estimates based on patterns in assessment responses. They are not deterministic predictions. Different inputs may produce different outputs, and the same individual may receive different results at different times.

    5.3. Known limitations. AI-Generated Content may:

  • reflect biases present in training data or model design, despite our mitigation efforts;
  • not account for all relevant personal, cultural, economic, or regional factors;
  • not reflect the most current labor market conditions, educational requirements, or career trends;
  • produce results that are inaccurate, incomplete, or unsuitable for your specific circumstances.
  • 5.4. No accuracy guarantee. The Company makes no representation or warranty regarding the accuracy, completeness, reliability, suitability, or fitness for purpose of any AI-Generated Content, Report, career recommendation, trait analysis, pathway simulation, or behavioral profile.

    5.5. Model updates. We reserve the right to modify, update, or replace our algorithms, scoring models, and analytical methods at any time without prior notice. Such changes may produce different results for the same inputs.

    5.6. Human oversight. We recommend that all Reports be reviewed in conjunction with a qualified human professional before any significant decisions are made based on them.

    6. No Warranty of Outcomes

    6.1. The Company makes NO representation, warranty, or guarantee that:

  • following any career recommendation in a Report will lead to career success, job placement, academic admission, professional satisfaction, or any other specific outcome;
  • trait scores, fit percentages, or compatibility ratings accurately reflect your actual abilities, personality, aptitude, or potential;
  • career pathway simulations reflect actual career progression timelines, salary expectations, or professional milestones;
  • any particular career is suitable for you based on Report outputs;
  • the career landscape will remain as described at the time of the Report.
  • 6.2. Career success depends on numerous factors beyond the scope of any assessment, including but not limited to: individual effort, economic conditions, market demand, educational choices, networking, personal circumstances, health, geographic location, and factors entirely outside the control of both you and the Company.

    6.3. You expressly acknowledge that the Company shall have no liability whatsoever for any career outcome, academic result, employment decision, or life choice made in reliance on the Service.

    7. Assessment Integrity

    7.1. You warrant that all responses provided during an Assessment are honest, accurate, and reflect your genuine views, preferences, and self-assessment.

    7.2. You acknowledge that the quality of Reports is directly dependent on the quality and honesty of your Assessment responses.

    7.3. If you provide dishonest, manipulated, inconsistent, or deliberately misleading responses:

  • all warranties and representations regarding Report accuracy are void;
  • the Company accepts no liability for the resulting Report content;
  • the Company reserves the right to flag or invalidate such Assessments.
  • 7.4. You must not:

  • have another person take the Assessment on your behalf;
  • use external tools, resources, or assistance to manipulate Assessment outcomes;
  • attempt to reverse-engineer the scoring algorithm to produce desired results;
  • take the Assessment under duress, coercion, or influence that may compromise response authenticity.
  • 8. Account Responsibilities

    8.1. You are responsible for maintaining the confidentiality of your account credentials.

    8.2. You must provide accurate, current, and complete information during registration and keep it updated.

    8.3. You are responsible for all activity conducted through your account, whether or not you authorized it.

    8.4. You must notify us immediately at security@paramai.in if you suspect unauthorized access to your account.

    8.5. The Company is not liable for any loss or damage arising from your failure to maintain account security.

    9. Institutional Use

    9.1. Institutional Responsibility. Institutional Users are independently responsible for:

  • obtaining all necessary consents from students, parents, and guardians before administering Assessments;
  • ensuring compliance with all applicable laws, including the Digital Personal Data Protection Act, 2023, the Right of Children to Free and Compulsory Education Act, 2009, and the National Education Policy, 2020;
  • the manner in which they use, interpret, distribute, or act upon Reports.
  • 9.2. Independent Controller. Each Institutional User acts as an independent controller (Data Fiduciary under DPDP Act) of the student data it uploads or causes to be collected. The Company processes such data on behalf of the institution as agreed under these Terms and any separate institutional agreement.

    9.3. Prohibited Institutional Uses. Institutional Users must not use Reports to:

  • make binding decisions about student stream allocation, course placement, or academic tracking without independent professional assessment;
  • discriminate against students on any basis;
  • deny educational opportunities or resources based solely on Report outputs;
  • share student Reports with unauthorized third parties;
  • use Reports as the sole basis for any administrative or disciplinary action.
  • 9.4. Institutional Indemnification. Institutional Users agree to indemnify and hold harmless the Company, its directors, officers, and employees against all claims, damages, losses, costs, and expenses (including legal fees) arising from:

  • the institution's misuse of Reports or student data;
  • failure to obtain proper consent;
  • violation of data protection laws;
  • any decision made by the institution based on Report outputs.
  • 10. Intellectual Property

    10.1. Company IP. All algorithms, scoring models, career vectors, psychometric matrices, assessment questions, report templates, scoring engines, behavioral telemetry systems, career knowledge graphs, pathway simulation models, genome similarity engines, and all other intellectual property embodied in the Service are the exclusive property of Param Innovations Private Limited and are protected under the Copyright Act, 1957, the Patents Act, 1970, and applicable trade secret laws.

    10.2. User License. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • access and use the Service for personal, non-commercial purposes (or commercial purposes if on an institutional plan);
  • view and download your own Reports for personal reference.
  • 10.3. Restrictions. You must not:

  • copy, reproduce, distribute, or publicly display any part of the Service beyond your own Reports;
  • reverse engineer, decompile, disassemble, or attempt to derive the source code, algorithms, or scoring logic of the Service;
  • create derivative works based on the Service;
  • use any automated means (bots, scrapers, crawlers) to access or extract data from the Service;
  • remove, alter, or obscure any proprietary notices or branding;
  • sub-license, sell, resell, or commercially exploit the Service or Reports without written permission.
  • 10.4. User Content. You retain ownership of the data you submit. By using the Service, you grant us a limited, worldwide, royalty-free license to process your data solely for the purposes of operating, securing, and improving the Service and generating your Reports. This license terminates when you delete your account, subject to legal retention obligations.

    10.5. Aggregated Data. We may use aggregated, anonymized, and de-identified data derived from your use of the Service for research, product improvement, and statistical analysis. Such aggregated data does not identify you personally and is not subject to the User Content license above.

    11. Data and Content

    11.1. Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

    11.2. You consent to the collection, processing, and storage of your Personal Data as described in our Privacy Policy and in accordance with the Digital Personal Data Protection Act, 2023.

    11.3. Where possible, we use aggregated and de-identified insights for product improvement and research, in compliance with applicable data protection laws.

    12. Payments and Plans

    12.1. The Service may include both free and paid features ("Plans"). Pricing and billing terms are displayed at the point of purchase and form part of these Terms.

    12.2. All prices are in Indian Rupees (INR) unless otherwise stated and are inclusive of applicable Goods and Services Tax (GST).

    12.3. Payments are processed through secure third-party payment gateways. The Company does not store complete payment card details.

    12.4. Refunds are governed by our Refund Policy.

    12.5. The Company reserves the right to modify pricing with 30 days' prior notice to existing subscribers.

    13. Third-Party Reliance

    13.1. Reports are generated for and intended to be used by the assessed individual (or their Guardian) only.

    13.2. No third party — including employers, educational institutions, admission committees, recruiters, or any other person or entity — may rely on a Report for employment decisions, admission decisions, scholarship awards, stream allocation, or any other purpose.

    13.3. The Company expressly disclaims all liability to any third party who uses or relies on a Report, regardless of how they obtained access to it.

    13.4. If you share your Report with a third party, you do so at your own risk, and you agree that the Company bears no responsibility for any consequences arising from such sharing.

    14. Limitation of Liability

    THIS SECTION LIMITS OUR LIABILITY TO YOU. PLEASE READ CAREFULLY.

    14.1. To the maximum extent permitted by applicable law, the Company's total aggregate liability to you for all claims arising out of or related to the Service, these Terms, or any Report, whether in contract, tort (including negligence), strict liability, or any other legal theory, shall not exceed the lower of:

  • the total amount paid by you to the Company in the twelve (12) months immediately preceding the event giving rise to the claim; or
  • Indian Rupees Five Thousand (INR 5,000).
  • 14.2. In no event shall the Company, its directors, officers, employees, agents, or affiliates be liable for any:

  • indirect, incidental, special, consequential, or punitive damages;
  • loss of profits, revenue, business, or anticipated savings;
  • loss of career opportunities, employment, or academic placements;
  • emotional distress, mental anguish, or psychological harm;
  • loss of data or data corruption;
  • cost of procurement of substitute services;
  • damages arising from career outcomes, academic results, or life decisions made in reliance on the Service;
  • damages arising from unauthorized access to or alteration of your transmissions or data;
  • damages arising from third-party actions or reliance on Reports;
  • regardless of whether the Company was advised of, knew of, or should have known of the possibility of such damages.

    14.3. Aggregate cap. The limitations set forth in this Section apply to all claims in the aggregate, not per claim.

    14.4. Essential purpose. You agree that the limitations of liability in this Section are essential elements of the bargain between you and the Company, and that the Company would not provide the Service without these limitations.

    14.5. Exclusions. Nothing in these Terms shall limit or exclude liability for:

  • fraud or willful misconduct by the Company;
  • death or personal injury caused by the Company's negligence;
  • any liability that cannot be limited or excluded under applicable mandatory law.
  • 15. Indemnification

    15.1. You agree to indemnify, defend, and hold harmless the Company, its directors, officers, employees, agents, contractors, and affiliates from and against all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable legal fees and court costs) arising from or related to:

  • your breach of these Terms or any other Agreement;
  • your misuse of the Service or Reports;
  • your violation of any applicable law, regulation, or third-party rights;
  • any decision made by you or on your behalf based on Reports or AI-Generated Content;
  • any claim by a third party arising from your use of or reliance on the Service;
  • your provision of inaccurate, misleading, or dishonest Assessment responses;
  • (for Institutional Users) any misuse of student data or Reports, failure to obtain proper consents, or violation of data protection laws.
  • 15.2. The Company reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with the Company's defense of such claims.

    16. Dispute Resolution

    16.1. Informal Resolution. Before initiating any formal dispute resolution, you agree to contact the Company at legal@paramai.in and attempt to resolve the dispute informally for a period of thirty (30) days from the date of the initial notice.

    16.2. Mandatory Arbitration. If the dispute is not resolved informally within 30 days, either party may refer the dispute to binding arbitration under the Arbitration and Conciliation Act, 1996 (as amended).

    16.3. Arbitration Terms:

  • The arbitration shall be conducted by a sole arbitrator appointed mutually, or in the absence of agreement, appointed in accordance with the Arbitration and Conciliation Act, 1996.
  • The seat of arbitration shall be Dhanbad, Jharkhand, India.
  • The language of arbitration shall be English.
  • The arbitrator's award shall be final and binding on both parties and enforceable in any court of competent jurisdiction.
  • Each party shall bear its own costs of arbitration unless the arbitrator directs otherwise.
  • 16.4. Class Action Waiver. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as part of any class, consolidated, or representative action.

    16.5. Small Claims Exception. Notwithstanding the above, either party may bring an individual action in the appropriate small claims forum for disputes within the jurisdiction of such forum, provided the claim does not exceed INR 25,000.

    16.6. Injunctive Relief. Nothing in this Section prevents the Company from seeking injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm.

    17. Governing Law and Jurisdiction

    17.1. These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

    17.2. Subject to Section 16 (Dispute Resolution), the courts in Dhanbad, Jharkhand, India shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms.

    17.3. These Terms comply with:

  • the Information Technology Act, 2000 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011;
  • the Digital Personal Data Protection Act, 2023;
  • the Consumer Protection Act, 2019;
  • the Indian Contract Act, 1872.
  • 18. Disclaimers of Warranty

    18.1. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

    18.2. To the maximum extent permitted by applicable law, the Company expressly disclaims all warranties, including but not limited to:

  • implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
  • warranties that the Service will be uninterrupted, error-free, secure, or free of viruses or harmful components;
  • warranties regarding the accuracy, reliability, completeness, or timeliness of any content, information, or Reports;
  • warranties that the Service will meet your specific requirements or expectations.
  • 18.3. No advice or information, whether oral or written, obtained from the Company or through the Service, shall create any warranty not expressly stated in these Terms.

    19. Suspension and Termination

    19.1. The Company may suspend or terminate your access to the Service, in whole or in part, at any time and for any reason, including but not limited to:

  • violation of these Terms or any other Agreement;
  • suspected fraud, abuse, or illegal activity;
  • request by law enforcement or government authority;
  • technical or security issues;
  • extended periods of inactivity;
  • failure to pay applicable fees.
  • 19.2. You may terminate your account at any time by contacting us at support@paramai.in, subject to legal retention obligations under applicable law.

    19.3. Upon termination:

  • your right to use the Service immediately ceases;
  • we may delete your account data in accordance with our Privacy Policy and data retention schedule;
  • all provisions of these Terms that by their nature should survive termination shall survive (see Section 24).
  • 20. Force Majeure

    20.1. The Company shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from events beyond the Company's reasonable control, including but not limited to:

  • acts of God, natural disasters, epidemics, or pandemics;
  • war, terrorism, civil unrest, or government sanctions;
  • power failures, internet outages, or telecommunications failures;
  • failure of third-party services, cloud infrastructure, or payment processors;
  • strikes, labor disputes, or workforce shortages;
  • changes in law, regulation, or government policy.
  • 20.2. In the event of a force majeure event, the Company's obligations shall be suspended for the duration of the event, and the Company shall use reasonable efforts to resume performance as soon as practicable.

    21. Modifications to Terms

    21.1. The Company reserves the right to modify these Terms at any time.

    21.2. For material changes, we will provide at least thirty (30) days' prior notice through the Service, email, or other reasonable means.

    21.3. Continued use of the Service after the effective date of any modification constitutes your acceptance of the modified Terms.

    21.4. If you do not agree with any modification, you must discontinue use of the Service and delete your account before the effective date.

    21.5. The current version of these Terms is always available at www.paramai.in/terms.

    22. Severability

    22.1. If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, shall be severed from these Terms.

    22.2. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

    23. Entire Agreement

    23.1. These Terms, together with the Privacy Policy, Disclaimer, Acceptable Use Policy, Refund Policy, and any signed institutional agreement, constitute the entire agreement between you and the Company regarding the Service.

    23.2. These Terms supersede all prior or contemporaneous communications, proposals, agreements, and understandings, whether oral or written, between you and the Company regarding the Service.

    23.3. No waiver of any provision of these Terms shall be effective unless in writing and signed by the Company. A waiver on one occasion shall not constitute a waiver on any other occasion.

    24. Survival

    24.1. The following Sections shall survive the expiration or termination of these Terms for any reason: Section 1 (Definitions), Section 4 (Nature of the Service), Section 5 (AI and Algorithmic Disclaimers), Section 6 (No Warranty of Outcomes), Section 10 (Intellectual Property), Section 13 (Third-Party Reliance), Section 14 (Limitation of Liability), Section 15 (Indemnification), Section 16 (Dispute Resolution), Section 17 (Governing Law), Section 18 (Disclaimers of Warranty), Section 22 (Severability), and this Section 24 (Survival).

    25. Compliance with Indian Law

    25.1. The Company operates in compliance with:

  • the Digital Personal Data Protection Act, 2023 (DPDP Act);
  • the Information Technology Act, 2000 and rules thereunder;
  • the Consumer Protection Act, 2019;
  • the Consumer Protection (E-Commerce) Rules, 2020;
  • the Indian Contract Act, 1872;
  • the Arbitration and Conciliation Act, 1996;
  • the National Education Policy, 2020 (where applicable to institutional use).
  • 25.2. The Company is registered as a Data Fiduciary under the DPDP Act, 2023 and has appointed a Data Protection Officer reachable at dpo@paramai.in.

    26. Grievance Redressal

    26.1. In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 and the Consumer Protection Act, 2019, the Company has appointed a Grievance Officer.
